some stupid bitch pulled out in front of me.......

first thing she says is "jesus chirst ow fast were you going? i didnt even see you so you had to have been flying...."

i said "i was going UNDER the speed limit, and your stupid ass started pulling into your driveway when i was like 5 feet from you"

them she proceeded to say "well....this is bad, because i DONT HAVE INSURANCE, and im filing bankrupcy....im completely broke....."

after alot of cursing onm my part we came up with the agreement that she FINDS a way to pay for the damages in 60 days or else i send that special little paper to the dmv that gets her license taken away until she pays the debt off, then she would also have to have sr22 insurance for 2 years after she got her license back.........good god it has been a bad weekend...on top of all that, my laptop was laying on the passenger seat.....and it is completely destroyed.....i went to get an estimate on the damage, and the lowest one was 1600.00 and the highest was 2300.00 which is a complete total.....BUT it doesnt matter because i gave her the highest one....

she THINKS she might be able to put this into her bankrupcy as a personal debt, and that will pay for it, but i dont know how all that crap works...

i will prolly have to take her to court over it.....my poor baby got all crunk!!

I'm NOT a big fan of dude2uc, since he's a hater, but he's 100% right. You need to file a police report. Even if it's late. Call the police, file the police report then ask them to visit the lady (since she was pulling into her driveway, you know where she lives). The police can document your damaged car and her damaged car. Also, show them the pictures.

MAYBE she plans to fix HER car in the 60 days, but NOT your car. After she fixes HER car, she might claim she wasn't in an accident w/ your car. That way she doesn't have to pay for your repairs and avoids the SR-22. Then she will fight you in small claims court.

Also, maybe she DOES have insurance, but is lying to you. Maybe she doesn't want her premiums to go up.

In any case, like dude2uc mentioned, you need the police report to protect yourself, and for your potential case in small claims court.

Make sure the estimates include genuine HONDA PARTS ONLY. Don't settle for less, you deserve no less.

Accidents are a fact of life, but you have to protect yourself. I had someone hit my '87 Civic trying to pass me on a ONE-LANE street. They claimed they didn't have insurance, but I waited for the police and filed a report to protect myself. They paid for my repairs, but the body shop used parts that were NOT genuine Honda parts. :( The body shop was looking out for the person who was paying the bill. So don't make my mistake. BTW, I'm never using that body shop again (brother of my cousin owns it).

To get the best estimate, go to honda, have them qoute you the price for each part that needs to be replaced (on paper, of course). Then go to a body shop and have them qoute you labor, paint, materials, and any other misc. things. Also, find the recipt to your laptop or get the average price off the same model from the net and take it to court.

Ive never caused/been in an accident, nor taken anyone/been taken to court but this should pretty much be common sense.


hostile... in defence of a guy i met in person, youd be surprised at how stupid some people are, there is a HIGH possibility that the girl was either a.) not paying attention, or b.) tried to beat him to the driveway. And, its harder then youd think to stop, take into account, both cars traveling towards each other at 25mph, is like 1 car traveling towards a brick wall at 50. But in this case, you have different reaction times to hitting the brakes, so one could of been doing 25 and slowing, while the other didnt do anything. Not to mention, neither of those cars will stop very fast from 25mph. You have an SE-i so you may have a little edge on braking, and i dont know about you but even braking HARD from 25-30mph, it takes a good 15-20 feet to come to a complete stop. Since both cars have front end damage it is incredibly hard to judge who was at fault.

oh dont worry guys, i got it all in writing, stationg that is 100% her fault, and she will do whatever needs to be done to pay for the repairs in the next 3 months. not only that, but i have a scan of her id, and social security card PLUS i have pictures of her signing the paper i had her write out. along with pictures of the whole scene, the tire marks from my car and the peel out marks from her car. i got my ass covered.


as far has her being pretty far into her turn......i was going about 20-25 mph, and she LOOKED like she was going to wait for me to pass before pulling in, you know....like any sane person would. but i guess she thought she would be ballsy or something, and gassed it, car peeled out, which fortunatley gave off obvious peel out marks and not brake marks......

Actually if she files bankruptcy (this is how it works in ohio mind you...) she or the goverment (state or federal) DO NOT have to pay a dime for the damages even if you file with your insurance company... I say this from experience, I filed for bankruptcy on some bills (12,000 dollars of them)
and one of them was on a accident I had with a 1998 Ford F-250 (I was driving my mom's '91 geo Metro, guess who had more damages...), it was only my fault cause I hit him... Supposely I tweaked his bumber way out of wack, which is fine I'll go with that, but in ohio you have 7 years to claim medical and he did it 4 months after.... I don't agree with that! 1) He was pulling into a bar... and admitted to the cop he had been bar-hopping all night. 2) I did NOT see any brake lights, taillaights, or turnsignals.

One or two years later there was a recall on ALL 98 F-250 for a bad wiring harness... In short I gave him and his insurance companie a big F. U. and included them in my bankruptcy. They said they would fight it when they contacted me (which is illegal to do after you sign all paperwork and it's in the preliminery filings..) and I never heard from them again... That was in '99.

In short, I did my time (30 days in jail max.), Paid the damages for his truck at least, lost my liscence for 2 and a half years and filed SR-22 bond for 3 years (suppose to be 7 but state lifted it if I went 3 years with no citations or tickets of any kind, speeding or parking)

My advice, Do what needs to be done to get the damages paid.... if it is RIGHT... but it's HER fault and you're NOT making stuff up soo...

and about the recall...you should have said...im not paying for what ford is at fault for [wiring harness] and fight it so that way ford pays for both of your damages because their faulty part caused the accident. big car companies get scared sometimes and pay up easy to avoid large lawsuits.

Who cares if she files bankrupcy? Control the things you can control, don't worry about things that are out of your hands. Bankruptcy is not something taken lightly. She would need an attorney. And bankruptcy protection can only be taken every 7 years. If she has already filed bankruptcy in the past 7 year, she's not eligible. If you file bankruptcy, and you incur debts that you cannot pay, you go to jail! Besides, if she owns the home that's attached to her driveway, I seriously doubt if she would jeopardize her home, just to get out of paying for an auto accident.

But it all starts with filing a police report. Have you ever watched any of those TV shows with (People's Court, etc.)? The first thing the judge asks for is the police report. Without a police report, it's all heresay. If the person who hit your car, claims she did NOT write that letter and that's not her handwriting, then it's just your word against hers.

Listen to ddude2uc and get that police report. Better safe, than sorry.
