man if your plate # was in the pic there would be problems, i don't think thay have to do anything about it if thay don't want to. if thay took the pic and then posted it, but thay just moved it from one site to another. your pic was already on the net. i don't know about useing it for marketing though.

Did you purchase your hood from them? If not, then they are guilty of false advertising. If so, there is probably a clause in their Terms and Conditions that allows them to use pictures of their customers cars for marketing.

Yep, thats my car. Before the z3's and paint. If you look at the pic, you can see my turn signal lights, I cut them from plexi glass, and painted the outer part on them black.
And it's my screensaver on my computer, so I KNOW that picture!
And, no my hood was purchased used from another member here, and he got it from Customcarbons.
I think I am going to e-mail them and tell them I would like a free hood for my troubles.:)

actually, it's copyright infringement. they cannot EVER do that. you have to ask permission of the photographer to use ANY photo for marketing purposes.

tell them that if they don't take it down or compensate you for using it, you will contact a lawyer familiar with copyright law and file a lawsuit against them.

yep this is true. u dont even need to register the images in your name for them to be your property. they are breaking the law technically, and you can demand royalties based on the ammount of people that see that image. :) it will be damn near impossible to get the money, but technically you are entitled to it

CarDomain only stamps the pictures if they are linked to another site, if you just go to the page and click an image, it's not going to have the stamp. Just FYI, but in this case he has the pics linked to here, so they should be stamped... hmmm

Unless you actually get a lawyer i wouldn't even bother any more.. and if you do have a lawyer, have the lawyer contact the seller next. otherwise i doubt much will happen

man doesnt anyone know the ebay way around here. just contact ebay from that listing and let them know that that is in fact your picture and youd like the auction stopped because they didnt have permission. ebay will autenticate the picture and cancel the auction. just like that.
