Busted_blue.....:violin:

Yesterday while going to work i was hit by a beautiful 2006 Lexus suv.:violin: I was waiting at a stop light when i exit the freeway. The light was taking for ever to change green. I noticed that a blue lexus stopped like 20 feet away from me. Then i saw the driver reach into her glove box. after that i really didnt pay to much attention but the next thing i knew i felt a bump and i heard plastic break. We exchanged information and everything. She did offer me to take it to a body shop and get it fixed at her expense and not go through our insurance. So tomorrow im taking it to M.O.B works in Orange and the Honda dealer in Hollywood to get quotes for her. If she says she that shes not able to pay ill just go through her insurance company. I got her driver license #, plate # phone #, insurance info. But she looks like a good lady so lets hope she dosn't fall through

That's a "nice" dent. Don't accept anything else than OEM taillights (not those cheap TYC replacement). Make sure they're not from an 86-87 too.

Specify that you want no body filler at all also (or the least possible)...

Dang. That sucks. Since your already getting an estimate, I would ask about that scratch you have on your rear bumper too. They'll probably think that was part of the accident.

She probably thinks all she needs to pay for is a broken tailight. She probably didn't see the bent trunklid corner piece.

M.O.B works quote came out to a lil over $1,700 and some change. I called the lady and she said it was ok and that if i felt comfortable in taking the car that shop. :D

is her insurance paying for it?,Most insurance companies will not pay for new parts on a car that old. Also they would not want to fix it anyway if it was over 1000 bucks.

If that happens say screw that and go find a blue trunk lid and then just have the body shop pull out the dent under the taillight.

yeah if they total it the car will not be worth it....i seen some nice fixed up cars on craigslist with a salvage title and they cant even sale it for how much the parts they used. and that does not look like 1700 bucks worth of repair. like russiankid said get a buddy to fix it and tell him to give you a lower estimate so she pays up instead.

They also said that ill get a rental for the day while they inspect the car. I'm meeting up with Miguel from M.O.B works tomorrow to see how much its going to cost to paint the whole car. I want to get the whole car painted under the carpets, inside the trunk, engine bay. ill pay for the rest of the body to get painted and let the insurance pay for the damages that the lady did.

wish me luck the insurance dose not screw me over!

Around here the cops will not respond to an accident call unless it is MAJOR, or if injury is involved. This situation illustrates why everyone should look at their insurance deductibles. Take your case, for example. If it costs, say, $1,000 to fix it why would you want to carry a $500 deductible on your auto insurance. In this lady's case, she may have several fender benders against her already and it ends up being a lot cheaper just to pay for yours out of pocket than getting her policy jacked up due to a claim. Fortunately, there are a lot of good used tailights out there and the bodywork you need is minimal.

Even worse, if it costs too much to fix you end up having her insurance carrier wanting to total your car in which case you end up spending way too much time on the phone with them working it out.

You might even try this. Just tell her you want $1,000 and you'll call it even. A lot of times people like that will be happy just to be done with it.

That sucks. I am not surprised though, because the insurance people are quick to total a car without looking throughout it. When my car was in a minor accident, less damage than yours even, the insurance tried to total it. My dad put up a fight and they looked at the inside and how clean the whole car was, and those two combined is what made them decide to fix it instead of totaling it.

The problem is that people don't want to fix old cars, even if they are in great shape. The insurance people want you to buy a new car so you pay them more per month to insure it, and the people at the body shop don't want to work on older cars because they're used to working on newer cars and are no longer familiar with cars like ours. I would dispute this if I was you because that damage is not enough to total it.

that really isn't that much damage,just get it fixed,the body shops just want an arm and a leg to fix something. as much history as that car has here,i'm sure we can get some three geezers to chip in as far as help and parts wise. like i said if you were here i would fix that in a couple of hours:)

yea cheese keep the car buy it back or what ever it takes i think we can come up with the stuff and when mine got hit it only costed $56 to ship it off ebay it can be fixed

how much would it be for them to fix just the body, not the trunk lid or tail lights? you could get those at a jy for cheaper than they're gonna charge to fix it. if you can't find a nice laurel blue one you could get a nice random color one and have it painted black maybe

I'm hoping i have the same luck with these bastids. also if they dont budge ill try to get the lady that hit me to convince them to fix my car. and ill probably need you help too guys by emailing the insurance company and letting them know about this car :)

If her insurance won't spend the money to fix your car back to the way it was with OEM taillights and stuff like that, then you have every right to sue her for the ammount that it will cost to fix your car. It's your car no one can take it away from you if you don't want them to. She has no choice in the matter of whether or not her insurance will pay it. Insurance does have the right to take your car if it is totalled and you want them to pay for it, but other than that the car is yours man. Take her to small claims court and you'll have your money man. We can't let people tell us what to do with our cars.

You have plenty of pictures and a good argument that the car is worth at least the top of the range, and maybe more. Negotiate with them as best you can, get the check w/o the salvage title option, and get the car fixed yourself. The damage isn't that bad.

Ok so i called the insurance company yesterday and the guy who is taking care of my claim didn't pick up again. so i left a message saying i was going to take the car to the body shop and have it fixed. I also told him that i was going to sue the lady who hit my car. Today i called again and he picked up. As soon as i told him my name he was like "ah yes Mr. Abraham" he made up some excuses why he has not called and that hes been backed up blah blah. But any who i told him about the car and i told him the rare parts my car had. He said that i could fax him the receipts of the parts that i added on to the car so he could adjust the value of the car. Only problem to this is that i really don't have receipts on most of the stuff :( Any suggestion on what i could do?

if all else fails then i will, but in a lighter note i went out to the junk yard yesterday and i found a B-49 laurel blue accord! the trunk was in mint condition, so i bought it. its only missing the "H" emblem but other then that its good. even the paint in in decent shape. I spent all day waxing it and buffing it and it looks clean. I just came from working on the accord and putting on the new trunk. Now that the new trunk is in and is not pushed in It looks like the rear frame is pushed in a bit. Im going to call the insurance company again tomorrow and see if they just wanna pay for the frame damage and the paint. I also bought the right side rear taillight

i know this would probably sound a bit cheap & crappy, but you could put a few washers between the metal piece & frame to bring it back out a bit, thats what i did lol

My taillight and the bar that goes under the coupe's lights were pushed in like that. Stuck a socket behind, centered on the bolt holes that were pushed in, and hammered away. It came out great, surprisingly.

o cheese if you do get blue fixed up remember to zink treat the area were the paint has peeled off... and any rust spots so she don't rot out on you :(

I dunno about you but where i live it goes like this:

1. Doesn't matter what the circumstances if you are stopped and get hit in the rear it is the other persons Fault!

2. They must pay for the accident if they are at fault.

3. Leave the vehicle where it is, do not move it, call the po-po and they will arrive make an accident report, and go from there with photos of the accident.

4. I know it's already done and gone but you should have the woman pay for it, get a laywer, sue sue sue... Good luck!

No need for a lawyer, I'd do small claims.

No Need for a lawyer in small claims, a smaller filing fee, etc etc etc

you can sue up to $7,500 in there too, not that damage is that but it helps to know

you even have the right to take the insurance company to small claims.

It looks sorta like my old se-i but not quite as bad when I spun out... I'm going to take a wild guess and say your frame is slightly bent... but hopefully you can get her back together soon as it would be a shame to see that car go.

Man up and fit it. :) Do you have another car to drive while you work on it? I know it's hard to fix when you have to drive it everywhere. I'd go to the salvage yard, get the parts, paint it, and then take her to small claims and give the judge the reciepts.

If by Friday the insurance dose not come up with an offer then im going to to Monday to the court offices and file to go to small claims court. Bite i do have another car but i have not driven the other accord in a year lol. and it needs work done. I am also in the process of giving that accord to a family member. Ill most likely rent a car.

Ok so i called the insurance company yesterday and the guy who is taking care of my claim didn't pick up again. so i left a message saying i was going to take the car to the body shop and have it fixed. I also told him that i was going to sue the lady who hit my car. Today i called again and he picked up. As soon as i told him my name he was like "ah yes Mr. Abraham" he made up some excuses why he has not called and that hes been backed up blah blah. But any who i told him about the car and i told him the rare parts my car had. He said that i could fax him the receipts of the parts that i added on to the car so he could adjust the value of the car. Only problem to this is that i really don't have receipts on most of the stuff :( Any suggestion on what i could do?

well the insurance company said that the total cost to fix my car was $2,700. the quotes i got was $1,700 im not really sure why they think it would cost another grand more to fix the car. but today is Friday. Like i said before today was the last day i was going to wait for the insurance company to settle. I did get a email last night
"Hi, so far, we are not adjusting the value of the ADP valuation.
However, your not loosing from this either.
Most of the parts you had requested are aftermarket and are maintenance
items. We do not add for maintenance.

I will contact the actual adjuster to see if there is anything that can

Thats annoying... I've had to deal with insurance companies before regarding accident claims and it's a bitch. Getting any sort of money unless you want to do everything their way, and use their shop, etc... is a pain in the ass.

Good luck with the small claims thing... sounds like the insurance company is being pretty retarded as I fail to see how taillights, trunklid, etc... could be considered maintenance items.

I have an update. like usual ive been busy with work and i have not had time to file for small claims. Today tho i received a email from bill again.

"We have a new valuation. The adjusters were able to come up with another $1000. I will mail you the new valuation and issue check early next week.

Dealing with insurance companies is a real pain. Years ago in New Orleans, I was in an auto accident. My mother was really hurt, but I had some smaller injuries. It happened in the summer, and that summer and fall went by because I was helping to take care of my mom. I eventually went back to school, and occasionally would call the insurance company about my claim (my mom's claim had been paid as we got an attorney -for her). The company kept stalling, and I was busy with school so didn't pay too much attention. As the next summer approached, a law school frat buddy of mine told me that Louisiana had a 1 year horizon on insurance claims - either settle or sue by that time. So that's what they were trying to do, stall it out beyond the year. I was so pissed I stopped being "reasonable," and brought out an old swimming injury to my knee as having happened in the accident, screaming into the phone etc etc. I ended up doing very well, but it was the memory of that scummy move on their part that has stayed with me.

update!


I wanted to let you know that i never received the letter i asked you to send. It could be that the fax that i have did not work. Could you send the letter by mail? Also I never was told how much i was going to receive. I was told that my car was valued at $1,700.00 then you said the adjusters were able to get another $1,000.00? that would be a total of 2,700.00? You also said there was going to be a charge for the salvage? As soon as i get the money and i get the letter we will be done with this claim. I really would like to get my car in the shop by the end of this month. Right now my trunk dose not close and it flys open when i am driving. Its going to start to rain and water can get inside. Also i was told by my co-workers that they saw someone snooping in my trunk while i was at work. I don't want to get anything stolen because my trunk dose not close Ill send you the recite that enterprise car rental gave me with the $35.00 today before i go to work. Let me know as soon as possible when you have anymore information.

Yeah im stocked that im finally getting somewhere with this claim. It was starting to feel like if i was the one to blame for the accident.
As far with the money goes. I was quoted 5 grand for the paint job. Its going to be a full paint job the whole car is going to be painted from top to bottom. (well not the bottom of the car lol.) but the engine bay, inside trunk, inside the car and door jams. That 5 grand could been higher but i told them that i was going to gut the car myself, and i was going to put the parts back. The only thing that i am not gong to be putting back is the rear and front bumpers. I am going to let them do that. but the interior is going to be gutted by myself.
I plan on using the money as follows.
Im going to the junk yard to buy the inner rear bumper and inner foam bumper.
Buy the front and rear bumper shell new from the dealer
have the body straighten.
what ever is left i will use it to go towards the paint
