Re: California State Referee Inspection 7.19.2007

Had he cited him for racing it would have been within his authority to look over the engine. But it doesn't state that he pulled him over for racing on the ticket. So based on that, what grounds does he have to search the engine compartment?
Like i said, the cop doesn't have to cite you for the reason he pulled you over. If it somehow went to court, all the cop has to do is say I pulled him over for such and such reason. Usually cops will make notes for each stop too so he might have a record of it as well.

Still he was going 45MPH on an onramp; that's hardly racing. And an honerable judge will know that. And if the officer doesn't have to cite you for the reason he pulled you over and can cite you for a different reason, then our laws are failing us. There should have at least been a documented warning issued to support the justification (justice is hidden within that word) of citing him for an emissions violation. And what the cop says (unless it's documented) is his word against the defendant. The defendant is innocent until proven guilty. The officer had no right to search the engine compartment if he didn't document the original reason for pulling over maxoutracer. Say what you want, what's right and wrong is what matters in the end whether he wins or loses. I for one believe that both were in the wrong. Maxoutracer should have had the carb sticker for his header, and that officer should have at least issued a warning for the racing to justify his claim to write him up for an emissions violation. I think if he fights the ticket he has a good chance of winning. Primarily because the VIN won't match the make. Since he wasn't racing Honda Integra, the ticket for emission is invalid.

LOL that sucks at least you got it taken care of for not to much $ i hope. The fact of the matter is that police can pull you over for any reason the most common bs line is rutine trafic stop. once they pull you over they can cite you for secconday offinces illegal mods, noise, poor restringht (sp) systems. if any of you get a speeding tickit allways set up a court date to contest it try to find you local laws and change the date at the last muite and usaly the cop has requested time off to testify and cant change to the new date. no wittness agenst you your off the hook this will work like 75% of the time trust me ive been pulled over 17times for speeding and still have a clean driving record but ya no emissions here

Can you change the date, in every state? LOL that rhymes. But I didn't know you could change your court date. I think I might just put Acura & Integra emblems on my car. I'd more than likely get out of it, especially since in my area they'll put a badge on anybody with a GED. By the way I am a GED grad. And I don't have anything against GED grads, just grads with badges.

Okay so wait a minute here, you got your car reffed, and kept the SS header on without the carb number and they gave you the OK?
