I called-I didn't threaten,curse or do anything to threaten anybody in fact I was polite about it(I do not know who calls at night but that's childish)-I simply asked if it was possible to get my money back through the paypal account that was used,that being tommy's fiance's account.The phone number was given when I sent my money to him so I assume it was given if any questions where to arise,I made the mistake of trying to help other members to figure out what was going on because others would not do so and it turned into a catastrophe.

how is it amazing that a police investigation would be involved??? this is a matter of interstate and internet fraud... 3000 dollars in a lot of states is considered GRAND LARCENY and carries a pretty hefty penalty... and considering this has to do with ACH payments that could be considered interstate wire fraud... i could go on all day about this... and you'll likely keep deleting my posts as you are clearly a blatant retard.

strange that tim from innovative seems to say that he never heard of a tommy or anyone trying to start a production run, yet tommy was around long enough to post pictures of the completed mounts... makes me wonder why everyone here was told that the mounts would be made and that they were still working and it takes time to make that many mounts, etc etc... yet again tim has no apparent reckoning of tommy or a group buy... strange. it's good to see that defense is still happening but i have to question how he "unfortunately didn't complete it" when it was apparently never started according to the main source of info that we have at this point.

As a point of correction, Tim is aware of Tommy. Tim does acknowledge that he coordinated with Tommy to use the Place Racing mounts as a starting template to work from, and build upon.

first of all , i dident know whos info that was, for all i know it was tommy. i went into my paypal account and got that info from my invoice. who the hell is supposed to know who you are. all i know is somebody better come up with my fing money. if you dident want your info given outm you should of made him open his own paypal account. i can care less about your stank attitude or tommys situation. and for the other guy, you know who you are, i did not leavve a nonrefundable deposit for anything, go back, read through the pages, i left a paid in full payment on a promise of these mounts being delivered. but as of today, my money has not be givent to innovative and apparently is not in this paypal account for refund. i have every right to be upset and ask for a refund. and i also have every right to post the personal info of the paypal account that was used to dupe me out of my hard earned money. i only posted the info to help those who were also missing money. no one said anything about harassing you, no hmt style call-a-thons, just getting info on tommyu and his situaion because no one really knew.

What is the current status?

At the moment, looking at this with eyes wide open, what we have here is a lack of updates and a lot of noise that has caused a sense of hysteria. ...and a whole lot of speculation into Tommy's personal life.

I think many have lost sight of what this is, and nwst8 has painted a pretty clear picture of that. This is a business deal. Yes, it was one made with a member who's credibility and reputation played a large part in making the deal actually get going, and generate serious interest.

To anyone that is calling at all hours of the night and/or making threats or carrying on in anything other than a civil tone, I think you really need to reevaluate your actions. Please please please do not make this a personal matter and please do not harass someone over this. We all have our own personal lives, and our own dirty laundry that does not need to be aired in a public forum. Please respect Tommy's and everyone else's psersonal privacy and stop the name calling, the desire to find out exactly where Tommy is, etc. It is of no business to any of us exactly what Tommy is in the midst of.

We can all speculate what's gone on here, and some will always be quick to wave the flag and make a big stink.

One thing we do know for a fact is that no-one has any of these mounts, and Innovative has yet to produce a set as part of a production run. If someone were to do further digging they would come to understand that although these mounts are listed on the site, and that Yvonne says they're available, ultimately they're still not yet sitting on a shelf ready to fill an order. Also, I have reason to believe that the final design has not been fully signed off on as of yet.

That said, despite the fact that Tim does not know of a group buy organized by Tommy, and that he has not received any deposit for more orders through Tommy, what we do know is that no-one could even have mounts yet even if Tommy had given Tim money or placed any orders.

I propose that Tommy had, and still has, full intentions of placing the order with Tim (Innovative) once the mounts had been finalized, and that time has just not yet come. If that is truly Tommy's plan, that time for him to place the order and transfer the money has not yet come. While it was expected by the purchasers that the money would have already exchanged hands to Innovative, and that they would have knowledge of the orders, we do not know if that's exactly what Tommy's plan was (and/or is). But we all did have faith in Tommy that he would produce a set of mounts to each person that had purchased or left deposit for them. At this point, there is no fact that he has taken the money and run, just lots of accusations of such. At the moment, if he is truly incapable of much of any communication, I think we need to have understanding that sometimes we cannot foresee every obstacle we may face.

Now I do agree that communication has been severly lacking, and that many may deduce that they've been deceived by not getting what they feel to be the 'whole truth', but....

....we ALL need to just take a deep breath for a second. Stop speculating, stop harassing phone calls, stop threatening legal action, and stop trying to delve into someone's personal life (for which there is no benefit in knowing really where Tommy is at the moment).

If someone were to request a refund due to the extenuating circumstances in this case, I think it needs to be done in a civil manner and with the understanding that they voluntarily agreed to send money for this and that a refund is well within right to be denied at this time. However, if such refund is granted, I do feel that it would show a level of both business and personal integrity due to the fact that this has not gone quite as smoothly as planned, and we do now know that the production of these mounts is not dependent upon each and every order or promisary deposit.

To Tommy's wife/fiance, I do wish you the best in taking care of your children in Tommy's absence. I do apologize that you have gotten piled on in this thread, and I do sincerely apologize if any members have been so disrespectful as to threaten or harass you personally. I do however hope that you can understand why some members of this purchase do feel 'duped' and angry about the current situation, although I understand that there may not be anything you can do at the moment and that this was/is Tommy's obligation, not yours.

As for the "non-refundable deposit", NO PAYMENT WAS EVER MADE TO INNOVATIVE. We're not pulling out of the group buy if it never happened. That's great, I'm sure you would keep it, just shows the type of person. I have never taken anyone's money without the goods ready or communication in case of a delay. Were were led to believe that innovative had our money and was in the process of producing our parts. I never prank called or threatened anyone and I don't see anyone else in the buy doing it either.

At best, this was a gamble as with any group buy. There are many ways to set one up. I have had my share of experience dealing with multiple suppliers.

But as most of you here probably live pay check to pay check, I can understand your concerns.

Life happens, for whatever reason Tommy is unavailable consider his right to privacy in that concern.

As for "US" as members of this group buy there are a lot of things you can try,whinning is one, b*t*ching is another, or you can attempt litigation ( Good luck finding a Attorney general, prosecutor to persue this without pressure from your attorney does $200-300 an hour sound about right)

As an experience owner/operator I have had to deal with alot of whinniers, threats and litigation. You have the burden of proof of any allegations not the accused. Innocent until proven guilty. Aside from one settlement client failed to pick paint colors (refund of deposit) 21 months later after mediation, only the lawyers come out ahead. This is why written contracts are necassary.

The group buy is still in effect as far as I see it, theres just a big monkey wrench that has been thrown into the mix.

As to the type of person I am, well I just won't continue to try and back the monies already involved.

This has proven difficult to achieve since Tommy's fiancee probably doesn't want to deal with any of us until she talks to Tommy and I'm thinking Tommy is going have a few choice words to express himself. Fare is fare.

As anticipated Tommy's fiancee will not respond. After the mistreatment she received while trying to calm the group buy members.

As it stands, in my opinion. You will not be hearing anything from her until Tommy is ready to deal with this.

You can scream all you want, it will do no good. If Tommy has suffered some set back that has forced him to put this group buy on the back burner. Then it is on the back burner.

Allegations are just that. You bare the burden of proof. I would encourage you all to sit tight and hope for the best. I still consider this group buy in force.

I understand you feel that things were not done in accordance within your satisfaction. I don't see anything here that set Tommy to a certain course of action. We know that that the mounts were produced Innovative shows this. So it would difficult prove this was a scam to begin with.

At this point you can, (I would not suggest and/or condone) harassing Tommy's fiancee any further. This is why my hands were tied to begin with.

I attempted to to intervine on the behalf of the group buy members, putting up my own money to do so. That was put to an end with the efforts of a few irrational actions.

Well I don't post much and have been watching this ridiculous 20 something page thread that was suppose to be a simple thing. I was going to get into this as well and sure glad I didn't. I am on other boards and the mods here really do a piss poor job monitoring and reigning things in. I for one would not be sitting tight and waiting to see what happens. That is a load of bunk!!! I would be saying someone stole from me and now they have dissappeared and mods want everyone to sit and wait??? LOL!!! Your kidding right? This gives everyone the fear of god in them if anyone tries to do something like this again. Since people have had their money grabbed from them and subsequently dissappeared with it can others now get them directly? They have to know about the knucklehead that took this to them and through his own irresponsibiilty put himself where he is not be be dealt with. Innovative is willing to sell these through the website, at full price. No mounts were ever produced for the group buy, as the order was never placed.

I completely see your point, and appreciate that you said all this. The issue here is that the mods, nor admins or any 3geez staffer had any involvement in this group buy. We did not, and up until this point have not, endorsed, organized, controlled or sanctioned any group buys (while representing ourselves as staffers). It's not to say that we don't want to do anything to help any members of this buy, or to reprimand any members that may be in the wrong, it's just that if we involve ourselves directly it would only be as individuals hanging ourselves on the line.

The unfortunate truth is that there's really nothing we, as staffers or "3geez" can do about this directly.

Also, despite Tommy's inability to respond (for whatever the reason may be), he has not missed the deadline for delivery of the mounts. We do know (with confirmation from Innovative) that the "group buy" as it was sold to our members, was NOT done with their knowledge or even by request of Innovative. What Tommy did do was promise that in exchange for the deposit requested, he would deliver a set of mounts by a certain date. Despite knowing that the details surrounding the initial order are completely false, we do not know his intentions regarding placing an order once he receives confirmation that the mounts are in fact available.

(It has been confirmed that even though they're on the website, and one staff member of Innovative claims their availability, that they are in fact NOT available as of yet.)

If a member of this buy wants to pursue legal action by way of a PayPal dispute, or speaking with a legal authority regarding their options for seeking reimbursement, we as staffers and as 3geez, cannot and will not stop them. I'm not suggesting someone do that, but I'm also not telling anyone they have to just sit tight. It's not my place to say or recommend anything.

mark, i asked www.builtbynotorious.com who are my friends IN REAL LIFE if they could order the mounts and they said that they could in fact order them. i waited on the phone while jesse (one of the owners of the shop) called and i listened. the price to them is actually about what you all paid for the group buy, so much for me not getting them at the same price right?

mark you also suggest a paypal dispute but this cannot be done as it was more than 45 days ago that tommy requested money.

my questions regarding this are what information does the staff have on the members when they sign up? i know this will never get resolved but maybe group buys should just be eliminated from 3geez.com period. put it in the rules that they are forbidden, i know that myself as well as lx-incredible will probably never take part in one ever again, especially not here.

i'm also sick of nswst8 coming in here and beating a dead horse, we know what you've said we can read the last 50 posts you've made, it's like he's tommy's spokesperson or something.
