when driving i accelerate to about 40km\h then i rev it to 5000rpm over it just revs but thee car wont accelerate past 40km\h ? this is in d4 , in d2 i can rev it and accel to 80km\h straight up ? is this the transmission / cv joint ?

more likely the trans or shift cable. check ur fluid and be sure to use a fluid equivalent to honda atf-z1. i use royal purple max atf and it made a very noticeable difference
can a stuffed air filter cause any problem?
not with the trans. it can cause reduced engine performance and mpgs

if i just hold the accelerator pedal down a little it wont over rev and gradually go faster but when i give it gas it revs at about 45km/h , is it definately the transmission ? i'd like to think it is something else ?
your atf level might be low (or need changing) you could try just topping it up and see if it runs better
Sounds to me like it is a slipping tranny. Do they sell Lucas oil products in Australia? If so buy a bottle of their tranny oil. I had a similar problem with a camry and that solved it. Cant guarantee a lifetime fix, but it will help you for the time being.
how long will it last with a slipping tranny ? we do have lucas oil products in australia , what would i be looking for in there product range? Im currently using a tq d3 transmission fluid !
